6. BASIX
BASIX AFFECTED BUILDING:
A building that contains one or more dwellings, but does not include a hotel or motel.
The following definitions are under Part 1, Clause 3 – EPA Regs
BASIX
AFFECTED DEVELOPMENT:
A BASIX
affected building
that is subject to, or the subject of the following types of
development:
Erection of a building
Change of use that will become a BASIX affected building
Developement that includes:
Alteration, or
Enlargement or extension, and
The cost of works is $50,000 or more
A swimming pool or spa, or multiple swimming pools or spas that:
Service only one dwelling, and
Have a capacity, or combined capacity of 40,000L or more
BASIX EXCLUDED DEVELOPMENT:
Development where BASIX does not apply:
Development involving:
A garage,
Storeroom,
Car port,
Gazebo,
Veandah or awning
Alterations, enlargements or extension to a
State Heritage register building, or
For any buildings that result in a space that cannot be fully enclosed (i.e verandah)
BASIX OPTIONAL DEVELOPMENT:
BASIX Affected Building subject to:
Developement that includes:
Alteration, or
Enlargement or extension, and
The cost of works less than $50,000
A swimming pool or spa, or multiple swimming pools or spas that:
Service only one dwelling, and
Have a capacity, or combined capacity of less than 40,000L
CERTIFICATION OF BASIX
DA Consents
(C 97A Regs) Consent Authorities will subject development consents to prescribe conditions imposing the fulfilment of BASIX commitments.
CDCs
(C 136D Regs) A CDC must not be issued unless subject to a condition requiring fulfillment of BASIX commitments.
(C 129A Regs) CDCs can be ammended with respect to BASIX commitments under the provisions of this clause
OCs
(C 154B Regs) A certifying authority cannot issue an OC (either interim or final) unless BASIX commitments have been fulfilled. A CA may rely on the advice of a qualifed person to determine if the BASIX requirements have been completed.
(C 154C Regs) Before issuing a final OC the AC needs to obtain a BASIX completion receipt.
